'Google ads don't infringe trademarks'




A European Union court advisor said that Google does not violate luxury goods makers' trademarks when it sells brand names as advertising keywords triggered by Internet searches.

The advisor's legal opinion will now be studied by judges at the European Court of Justice, which has been asked to tell a French appeals court how to apply EU trademark law in a dispute between Google and several French luxury goods companies over the Internet search engine's ad system.

Advocate General Miguel Poiares Maduro did not give Google a complete all-clear, warning that it could be held liable if brand owners could show that Google's ads had damaged their trademarks. He did not accept Google's argument that the Internet advertising system is a neutral platform that would exempt it from similar legal action in the future.

While Maduro's recommendation is not binding on the court, legal advisor opinions are followed by the court in about 80 percent of cases.

The French companies - including LVMH Moet Hennessy Louis Vuitton - complain that Google broke the law by accepting ads using a brand name without permission.

They fear this would allow counterfeiters buy a keyword such as "Louis Vuitton" on Google's Adwords system and use it to sell fake bags when a user taps the phrase into Google's search engine, the world's most popular.

The court advisor said neither Google nor advertisers are at fault for initially placing or accepting an ad using a brand keyword. Google isn't to blame either for displaying the keyword ads because Maduro said simply seeing the keyword isn't likely to lead customers into mistaking a brand name item for a counterfeit.

But users are likely to make decisions when they see the content of the ad or visit the advertised sites - and the advisor warns that Google may be held liable for the ad content.

This could potentially lead to Google facing legal action in national courts if brand owners could prove that such an ad damaged sales of genuine goods.

Google has "a direct pecuniary interest in Internet users clicking on the ads' links," said a statement from the court's press service, which means it can't claim the same immunity as a search engine which EU law sees as a neutral information vehicle.

Google says it now screens the automated Adwords system for obvious abuse of trademarks but that it can't be held accountable for every instance where an advertiser tries to buy a brand name.

Google's senior litigation counsel for Europe, Harjinder Obhi, said the company also believes that "consumers are smart and are not confused when they see a variety of ads displayed in response to their search queries."

The EU's Luxembourg-based high court expected to rule on the case in the coming months.

Over 50% of businesses have iPhone users, but only 27% of IT departments support it


When Apple recently announced its SDK and Exchange support for the iPhone it unleashed a lot of talk about the iPhone becoming an enterprise powerhouse and even a BlackBerry killer. I thought it would useful to see where the iPhone currently stands, so that we can track its progress over the next 12-24 months and see what kind of traction it gets in the enterprise.
I recently ran two polls in which I asked if people had iPhone users in their businessand whether the IT department supported the iPhone.
The first poll revealed that over half of businesses have iPhone users.

The second poll showed that there’s a much smaller percentage of IT departments that actually support the iPhone.



Keep in mind that this was not a scientific poll, and that the percentages and the number of respondents are as of March 20, when I am writing this post. The polls are still open so the number could still fluctuate a bit. Also, since this is a voluntary poll it’s likely that it attracted people who were interested in the iPhone to respond. Thus, the number of businesses where there are iPhone users could be a little high, and so could the number of IT departments that support it.
However, one thing that is clear and undisputed is that there are a lot of companies that currently have iPhone users who are not supported by IT. This is the type of situation that I was talking about in my recent column “Sanity check: Should IT support user-owned smartphones?” The idea is that it’s better to support user-owned smartphones and at least have some idea of what you’re dealing with — and maybe even put a few guidelines and protections in place — than to say ‘No’ to supporting user-owned devices and have a bunch of users putting business data on their devices behind your back.
This user-owned smartphone issue isn’t exclusive to the iPhone, but based on TechRepublic’s data, the issue is definitely acute for iPhone users and their IT departments. Apple’s iPhone SDK and recently-announced enterprise improvements should definitely get more IT departments on board to officially support it.
However, it will likely take a couple years before it becomes a major threat to BlackBerry’s enterprise dominance because BlackBerry has been working with IT departments for almost a decade to tailor a solution to their concerns and needs. I also have my doubts about whether the iPhone’s on-screen keyboard can stand up to the large amounts of data entry that is done on enterprise-class devices.

IT organizations face some hard choices when going for modernization. Before choosing the modernization path, various analysts advise that IT managers need to take the important first step of understanding and assessing current IT assets.
Go on as before: Organizations may choose to not act, to continue monitoring and maintaining existing systems and infrastructure. There are costs to this choice but without adequately trained staff, doing nothing is becoming harder for facing competition.
Retire and replace the systems: This approach can be expensive. Turning to SOA can be a wise decision.
Modernization: This can take many forms, including using SOA to extend some of the legacy data via web services and re-hosting. But migration to new languages and new platforms must be undertaken deliberately and with experienced partners.
Application Portfolio Management: The premise of APM is that before prescribing remediation of a legacy system, customers need to know what they have currently. APM provides the ability to assess the complexity of assets. APM can be done in as lightweight a way as simply filling spreadsheets with code counts—or to seek help from vendors and partners.

Pathway for Modernization
By modernizing existing technology with the help of various applications provided by companies like Oracle can reduce costs, increase agility, eliminate reliance on legacy skill sets and satisfy compliance requirements while preserving business-specific data and functionality.
Re-hosting: firms can shift an application to another without disturbing the day-to-day business.
Re-architecting: organizations can use tools to reassemble the business-relevant code from legacy applications while eliminating technology-specific code.
Commercial Off -the –Shelf (COTS) Replacement: managers can replace a legacy application with a COTS application.
SOA Integration: firms can wrap the legacy applications, creating SOA services that function on a new platform but are implemented by the existing code.
Automated Migration: IT professionals can automate the migration to new technologies, as it does not change the application design.

Conclusion
Modernizing the IT infrastructure, by moving to open standards or using service-oriented architecture, will increase efficiency and transparency and as a result will transform the service delivery.

Will Google encash Microsoft and Yahoo deal?





The long discussed Microsoft Yahoo deal is on the verge of closure and is now with anti-trust authorities for the final decision. The concerned authorities are scrutinizing its pros and cons, and closely analyzing its implications in the short and long term.

The deal had undergone many phases and many considerations. It was picked up last month again after its failure last year due to Yahoo not agreeing to the Microsoft payment terms. Where reviewers peg it as a deal to spell end for Google’s monopoly, others find it a chance for Google to improve on its offerings. Google is touted as one company that keeps constantly innovating and improvising; the deal will induce more momentum and zeal.

Where EU (European Union) and DOJ will remain busy in analyzing the impact of Microsoft and Yahoo deal on online business, Google can find ways to remove the label of “data capturing search engine.” The deal will put pressure on Google to make its privacy policies more stringent and at par with the other two leaders.

The story has more to it. Google can innovate rather than just iterate and can look for other viable options that can help it to get engaged with users more deeply.
Google's advantages over other
Google has the lion’s share of search market and earlier it has to defend its territories from Microsoft and Yahoo, but now its fears are just limited to Microsoft in Web search spectrum. In the ad spectrum, still it has to fight with Yahoo but now the competition has been trimmed to one candidate in a field.

Bing is worth a good bet on internet spectrum and in search gamut. In fact, the reports suggest that it had assimilated good market share in last two months where as the shares for Yahoo and Google have slipped.

What could be better than having the rivals’ workforce arriving at your doorstep and that is what Google can really look upto and can even target them. With Yahoo users going off the board, Google can make offers to them and can even exploit their talent hub for further improvements.

Intel has introduced one of its latest developed Universal Serial Bus called USB 3.0 which is the latest super speed personal connector which can perform 10 times faster compared to its predecessors. This device has been designed to provide a solution for transferring data in computers, mobile phones, and other digital media appliances.
This device has also been designed to provide low-power consumption and improved energy utilization process. While the USB 3.0 has been made to provide greater bandwidth capacity to support video cameras, flash readers, and external hard drives, this blueprint is still undergoing various modification and can be expected to be released to the general public in 2009 or 2010.

Most of USB devices have some drawbacks and one of these is high CPU usage. To address this setback, experts suggest that specs such as sustainable power consumption, channel capacity, and cable length must be first modified and developed to maximize its functions.
Another impressive feature of this USB is that it can effectively identify if the port is in inactive condition, after detecting this, the device will then automatically cut the power supply to conserve electricity. In spite of the fact that this has already been introduced last year, there is no manufacturer or company that has proclaimed its willingness to produce consumer electronics products which will utilize this standard.
The USB 3.0 will require fiber optic cable. This prototype has also been designed to provide full compatibility with USB 1.0 AND USB 2.0.

Facebook Lite: An assault to Twitter?

Facebook, the world's biggest social networking site has launched a slimmed-down version of Facebook called “Facebook Lite” for people with slow internet connections. The new site will be faster and easy to work as it features fewer services than the main website.
According to the company, the “Lite” version is targeted to the audiences present in various developing countries, where bandwidth constraints make the current version too slow or unable to use. Currently, the application will be available in India and US.
The company announced that about 70% of its 300 million users are from outside America. Various countries from Southeast Asia and Europe have been witnessing a massive spurt in growth where fast internet connections are more common. Therefore, the company has been working on the ‘Lite’ site since August for the rest of the world that have slow net speed.

'Twitter-like' features
According to various analysts, the new version is similar to Twitter and Friendfeed, where users can send short messages or ‘tweets’ to other people. In the new Facebook Lite, users are now limited to write on their wall, post photos and videos, view events and browse other people's profiles. The new site has also sacrificed some of key features of original Facebook like special boxes, chat systems, links to applications and notifications.

Is ‘Lite’ an assault on Twitter?
It is speculated that the new Facebook’s site is a direct assault on increasing popularity of Twitter. After Myspace, Twitter is emerging as the main competitor for Facebook. In view of leading the competition, Facebook has constantly innovated and made certain improvements like inclusion of public profiles, profile fans, public status updates and real-time search on its main website. The simplicity of Twitter is tagged as the main reason for its popularity and Facebook is all set to rival that with its new "Lite" version.

Positive aspects:
1.      The new website has no application similar to the main site, hence people who do not want to see people’s annoying quiz results and their latest scores on Bejeweled, they can focus directly on their updates.
2.      Now, the new application can be easily used on various Smartphones.
3.      It reminds the older and simpler versions of Facebook that was only related to friends and family updates.
4.      There is a “View Top Stories” link so user can see which of their friend’s posts are getting the most comments/likes.

Few negatives
1.      It does not have a chat feature, which is must for any social networking site.
2.      The new Lite version allows user to view only two to three photographs at a time on one page, which is sometime very annoying.
3.      It can be called just an effort to become more like Twitter.
4.      The link for any quiz participation and game is missing in this new version.

Conclusion
The new Facebook Lite is reportedly created for users in countries such as China and India, where internet connections are not always the fastest or the most reliable. Further, it can be used on various Smartphones as well. But, it is certain that with a user base of more than 300 million, Facebook Lite's impact could be rather heavy on its competitors.

The International Consumer Electronics Show (CES) is a much-awaited event that was held annually in Las Vegas, Nevada. This is a trade-only show where new and old products are introduced to audience mostly composed of people from media, celebrities, gadget experts, and other notable personalities.
This event is not open to the general public since it is considered as one of the major technology-related trade shows in the US.

This affair was first held in New York City in June 1967. In 1978 to 1994, this event was held twice each year; first from Las Vegas (January) called as Winter Consumer Electronics Show (WCES) and in Chicago, Illinois (June) known as Summer Consumer Electronics Show (SCES).
The trade show changed its usual affair of twice a year. The organizers had decided that the electronics trade show should be only held once in Las Vegas.
In 2005, there was a funny incident that had occurred when Microsoft chairman Bill Gates demonstrated an electronics device which failed to work, making the audience laughed and be amused with it.
In 2006, the electronics show was held for three days starting from January 5-8. The venues were Alexis Park Hotel, Las Vegas Convention Center, Las Vegas Hilton Hotel, and Sands Convention Center. High Definition television is the central theme, but Blu-ray was trying to get the spotlight away from the HD television. Philips also introduced its rollable display prototype which features a screen that can retain an image for several long months even without the use of electricity. Attendance reached a whopping 150,000 people in 1.67 million net square feet of space, thus making it the largest electronics event in the country.
In 2008, the exhibition started from January 7-8. One of the main speakers was Bill Gates who formally announced his retirement from Microsoft. The eye-catcher product this year was the Panasonic which impressed the crowd with its latest innovation, the 150-inch Plasma TV.

Microsoft acquires ERP products to strengthen vertical approach




Microsoft, the software giant has announced the acquisition of ERP products from four smaller ERP vendors. The acquisition is backed by the possibilities to give Oracle or SAP ERP a run for their market share.

Microsoft is optimistic that with the acquisition of ERP products, the company can grab some share of divisional business from large units that run on standardized Oracle or SAP ERP. 

The company aims to integrate those products into the Microsoft Dynamics AX suite. Among the acquisitions done, the company has acquired process manufacturing software from Fullscope, professional services software from Computer Generated Solutions, and retail software from LS Retail and To-Increase Denmark.

Till the updates, financial terms of the deal have not been disclosed.

Microsoft Dynamic AX suite
 was planned after the acquisition of Navision in 2002 and the product is aimed at upper end of the midmarket. The approach is towards involving the mid market customers in vertical strategy and the large influx of partner involvement has made it appealing for Microsoft.

It seems that after gaining a better control over the vertical strategy, Microsoft can better position those products globally.

Adobe taps social networking media, announces availability of Flash Platform services



Adobe, the leading documenting software maker has announced a new Flash platform that will allow users and developers to share Flash platform.

The company has revised as how its Flash applications are used and has gone viral to make Flash apps more social. It will help users to share Flash Applications rather than leading to them an “install” link.

Sensing the current flow of technology and in wake of tapping the potential of social networking, the company is promoting the social and viral distribution of Flash applications on the Web, PCs and mobile devices. 

The company has announced the availability of Adobe Flash Platform Services that will facilitate application distribution, tracking, and monetization. It will be regulated by three main components namely Distribution, Collaboration, and Social.

Intel introduces Moblin 2.1 with Smartphone capabilities




Intel, the chip giant has introduced an enhanced version of its mobile Linux operating system, Moblin 2.1.
With Moblin 2.1, Intel is planning to expand its reach into mobile devices. The chip maker has added phone and social networking capabilities to its Linux based operating system and is targeting Smartphones.

The new version for Moblin 2.1 was shown at Intel Developer Forum event. The Moblin was earlier pegged for netbook line of products but the latest version has the Smartphone functionality too.

The new version along with Smartphone capabilities has other features also including calendars, social networking, and news updates. The operating system is also provoked with Motorola’s MotoBlur services designed for the Android-powered Cliq.

It is speculated that Intel’s partnership with Nokia to manufacture MIDs could ride on the launch of Moblin 2.1. However, Nokia is also pushing its Linux based Maemo platform.

Also, the company has plans to launch its Moorestown platform that will follow its successful Atom line-up.

Dell to purchase Perot in $3.9 billion deal



Dell Inc, the PC maker has announced the acquisition of the technology services provider Perot Systems in a cash transaction valued at $3.9 billion.

The deal will help the company to diversify beyond its hardware business and to take on rivals Hewlett-Packard and IBM in the lucrative software solutions and services space. Further, it will provide an edge over IBM, Accenture and Indian technology services providers such as TCS, Infosys and Wipro as Perot is a specialist services provider.

The new combined entity will have total revenues of $7.7 billion, where Dell’s revenue totals to $5.1 billion and Perot's $2.8 billion.

Under the deal, Dell will acquire all outstanding common stock of Perot Systems for $30 a share in cash, which is a premium of about 67.5% on the script's Friday's closing price of $17.91 on the NYSE. According to sources, the deal is expected to close by December this year.

With strength of about 24,000, Perot provides IT services and business solutions to customers in healthcare, government and banking space. The deal had been in the works from 2007.

Yahoo announces $100 million campaign, "It's You"



Yahoo Inc, the number two search engine has announced to kickstart a $100 million branding campaign called "It's You." The new campaign revolves around the current position of Yahoo in Internet landscape and will also strengthen the message of how Yahoo wants to be the center of online life of users.

The marketing message centers around the word "you," making a play on Yahoo's iconic "Y" in phrases like "It starts with You" and "It's You." Various analysts said that the web site has been attracting lot of visitors already but the campaign is necessary to provide information to people about recent enhancements to its key products, like home page, search engine and Webmail service.

Yahoo has also announced that the new campaign will highlight its strength in blending Internet technology and communications services with a vast selection of news and entertainment content.

Reliance Comm to sell its 10% stake in Rel Infratel



Reliance Communications Ltd., India’s second-largest wireless carrier has announced to sell its 10% stake in its Reliance Infratel Ltd.

Reliance Infratel Ltd is a telecommunications infrastructure unit. According to the latest updates, Reliance Communications is seeking regulatory approval for sale of its 10 percent stake in its Reliance Infratel Ltd. unit.

Earlier to this, the telecom infrastructure unit has already sold a 5 percent stake to seven global investors for about $290 million in 2007. Earlier, the company has plans to sell off plans back in 2008, but the company delayed its plans in view of slumping India’s benchmark stock index. The India’s benchmark stock index slumped 52 percent.

The sale will also help Reliance Infratel to pull funding for nationwide network of 48,000 towers as demand for leasing networks increases.

The related sources cited that Reliance Infratel is reviving its plan to raise around $1 billion by selling shares.

Google News witnesses two hours outage



Google News, the online news aggregation service by Google witnessed outage yesterday for long two hours. It would have affected referral traffic on many of the online publications, says market watchers.

The unavailability of news service for long two hours has led to a decline in referral traffic across many online news publishers. This is not the first time that Google is facing such a problem. Few days back, Gmail also faced the same problem. The mail in fact had faced the outage problem thrice this year.

According to the recent updates, Google News service was down from about 12:25 p.m. to 2:20 p.m. PDT. However, the issue has been resolved for now but it again fuels the debate of cloud services over conventional approach. The problem occurred due to a router overload after some routers were taken offline for maintenance.

The related sources said that web services are commonly faced and indicated that even Facebook users faced problem while logging into the site on Monday.

The outage seems to be a recurring problem with many of the Google free services. To maintain the performance scale of many of its paid service, Google maintains an Apps Status Dashboard but no such information is offered for its free services.

Vodafone unveils its Internet service, Vodafone 360



Vodafone, the second largest mobile telecom group in the world has announced a Web service meshing social networks, contacts and entertainment to compete with Apple, Google and Nokia.

Vodafone said that its “Vodafone 360” service would be available on two Samsung mobiles and four Nokia phones in eight European countries by this Christmas. The new service will offer visitors to synchronize their contacts from social networks such as Facebook and other Internet accounts.

Analysts predict that the vendor is planning to increase customer loyalty and data revenues in the face of stiff competition from Apple's iPhone, RIM's Blackberry and Google's Android platform, which all offer applications such as games and music applications.

At present, Vodafone 360’s catalog offers over 1,000 applications will be available at launch. However, non-Vodafone customers will also be able to access some of the services.

Would Google Chrome eat away its competitors?



When it comes to browsers, a latent war seems to have begun silently. Where there is cut throat competition and a constant battle to prove one another superior, there are a few who rein the markets on the basis of their market worthiness and credentials. Google Chrome has suddenly become an emerging threat for some its counterparts. Not only have been  the critics applauding the browser for its advanced and sturdy features but it is visibly surpassing its contenders and would soon outwit figures hence establishing itself as a superior and a well vetted product across the Worldwide industry.


Considering a perennial view of the Markets, reports point towards a declining Microsoft Internet Explorer market share which has dominated the entire show hither to. August it seems was a sour month for the software big wig. On the contrary, Firefox seemed to have gained about 0.51 percent market share and hence acquiring a total of 22.98% market share.


Safari seemed to be commanding 4.07% and Opera stood at 2.04%. Where Safari market share has been stagnant, the recently unleashed Chrome has already managed to get about 2.84%.
There is more to the story than it seems, Google seems to have confirmed on an agreement with Sony to make Chrome the default browser on some of Sony's PCs.


Now that does not sound like some really good news to Microsoft that has been bleeding profusely and hopes to remedy and save some through the much awaited launch of Windows 7.


However there have been varying market reports suggesting different market shares for different browsers. Seems like a never ending phase.

Tech Mahindra signs $400 million deal with Etisalat DB



Tech Mahindra, the Indian software outsourcing giant has entered into a 10 year deal with telecom operator, Etisalat DB.
The deal will provide the telecom operator with IT solutions and infrastructure requirements for its services that will roll out in 15 telecom circles. Both the parties have entered into $400 million deal that will stretch for 10 years.
Under the terms of the deal signed between both the parties, Tech Mahindra will take care of implementation of end-to-end IT applications and infrastructure of Etisalat DB and its subsidiary.
Etisalat DB Telecom is a joint venture between UAE-based Etisalat and Mumbai's Dynamix Balwas group and pioneers in state-of-the-art telecom infrastructure.
The company has the unified services access license for 15 circles enabling it offer mobile telephony, Internet service as well as fixed line telecom service. Globally, Etisalat has roaming deals with 520 operators.

VMware intros new virtualization services, vCloud Express and vCloud API

The new service runs on VMware vSphere platform and will enable users to start from basic and to grow into full enterprise-class cloud environments. The new service promise more reliability and faster access to a pay-as-you-go infrastructure and is compatible with many in-house VMware virtualized IT environments. The enhanced compatibility eases the task of interoperability and portability of applications.

The customers will be able to purchase the service through various service providers including Terremark, BlueLock, Hosting.com, Logica, and Melbourne IT.

India 3G and WiMax auction rescheduled for December



The date for India’s 3G and WiMax auction is now rescheduled to December, as per the latest updates.

The auction was early scheduled for January 2009, but has been regularly postponed and delayed due to several disagreements. The bid has faced various disagreements within the government on the minimum cost of license.

The minimum revenue for the auction is now settled at INR 250 billion.

It is expected that now after the revised dates, bidding for 3G licenses will start Dec 7. The auction for WiMax will then start after two days of completion of 3G bid. The bid is open both for Indian and foreign telecom operators; conditionally foreign operators run joint ventures with Indian investors to run services.

The details for the auction reveal that four slots will be put to auction for 22 service areas and the remaining one slot will be reserved for Indian Government run Telecom Companies.

The final date for applications from telecom bidders is November 13.

Intel veteran Patrick Gelsinger departs, major shuffle in management likely




According to latest update, Intel Corp, the chip maker is expected to announce a management shuffle, which will see its core chip business-head Mr. Patrick Gelsinger leave the company after 30 years.

The report further added that 48-year-old Mr. Gelsinger has left the Intel job and would now run computer-storage giant EMC's storage-products operations and some smaller software units. 
Mr. Gelsinger had joined Intel in 1979 and led Intel Labs, which encompasses many Intel research activities, and was Intel's chief technology officer.

After the departure of Mr. Gelsinger, it seems that Sean Maloney, Intel's head of sales and marketing, would take on an even larger role at the company. Also, Intel is expected to reveal a sweeping management change on September 14th.

Now, all of Intel's major chip businesses, including its PC, graphics and server chips would fall under Sean Maloney. Further, Mr. Dadi Perlmutter, the head of Intel's laptop chips, would oversee engineering for all the chip divisions after the reshuffle. 

Various analysts consider Mr. Maloney, Intel's sales chief as one of the possible successors to Intel CEO Paul Otellini.

Is Bing 2.0 next on Microsoft cards?




Bing, the so-called Google rival from Microsoft is now getting its second iteration. The insiders have spilled the beans on Bing 2.0.

It is expected that at the annual meeting of the company, employees were previewed with some new features that will be hosted in the newer version of Bing. The search engine can be rolled out on next couple of weeks. 

The analysts are speculating that among new features, users will be able to see maps plus pics or bing supportingSilverlight in its maps.
